Following are the terms and conditions of use (hereinafter the “Terms of Use”) of the “The Friends from the Jungle”, "world of numbers" and "world of letters" mobile application by BIMBOX (hereinafter the “App”).

General Provisions

1. By downloading and/or using the App, you accept and agree to the Terms of Use set out below. Please read these terms carefully before using the App. If you do not agree to the Terms of Use, you may not download, install or use the App.
2. BIM – Brand IT Media Ltd. (hereinafter “BIM”) may update, amend or change the Terms of Use at any time and at its sole discretion, effective upon the posting of the revised Terms of Use. Your continued use of the App shall be considered your acceptance of the revised Terms of Use.

Conditions of Use

3. The App is designed for use with “The Friends from the Jungle” , "world of numbers" and "world of letters"cards game by BIMBOX (hereinafter the “Game”) and is not a standalone experience.
4. To use and explore the features of the App you need to purchase the Game, which includes designated cards that activate these features as the smartphone and/or tablet camera scans the cards.
5. By accepting the Terms of Use, you grant the App access to your device’s data, camera, SD content, and GPS location data, as well as your personal information. The App requires the use of location-based services, subject to your device’s By enabling the App’s location-based services, you agree and allow BIM to collect, store and use your location data. Please note that turning off location-based services may affect certain features of the App and/or prevent its proper operation.
6. The App requires Internet connection for its operation; the connection can be Wi-Fi or provided by your mobile network provider. If you do not have an adequate Internet connection/Wi-Fi connection and/or slow Wi-Fi connection, then the App may cease to function properly in whole or in part. To improve the quality of the user experience and to make full use of the App’s available functions and features, it is recommended to improve the Internet connection of the device where the App was installed.

 Privacy Policy

7. BIM attaches great importance to protecting your privacy, and shall not provide your personal information to third parties, unless obligated to do so by law, or when faced with threats of legal proceedings (criminal or civil) due to actions carried out by users on the App. In such case, BIM is entitled to provide information to the party claiming to be harmed by the user, or in accordance with the provisions of a court order.
8. During the use of the App, BIM may collect information about your use of the App, including information about the content you have accessed, viewed, followed, marked, commented on, or shared. BIM may also collect information from third parties regarding the use of the App. BIM may use the information collected through, and in connection with the App to contact the user, as well as to improve and enhance its services and/or promote its marketing activities.
9. BIM takes all reasonable and necessary precautions to protect the information stored in its system from misuse, loss and unauthorized access. However, internet usage and activity is never guaranteed as completely secure, therefore BIM cannot fully ensure that the App and/or the system will not be damaged by third parties, as often occurs on the Internet, even after all reasonable and necessary precautions were taken.

10. BIM BRANDS LTD built the BIMBOX Apps (Free app) 
    This service is provided by BIM BRANDS LTD at no cost and is intended for use as is.

    The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at BIMBOX Apps unless otherwise defined in this Privacy Policy.

    Personal data means personally identifiable information that specifically identifies you as an individual (e.g. your name, email address, phone number). We do NOT collect and store any personal data.

    We may disclose Non-personal data to third parties and/or allow third parties to collect Non-personal data through their own embedded technology. 11. NONE of our apps will request you location data.

    We disclose information to respond to court orders and other legal processes as well as to establish/exercise our legal rights or defend against legal claims. We will share available data in order to investigate, prevent or take action against illegal activities, suspected fraud, potential threats to the physical safety of any person, violations of our Terms of Use or as otherwise required by law. 11. BIM grants you a non-exclusive and perpetual license to download and install the App on your tablet and/or mobile device, for personal and non-commercial use only and for the purpose of the Game.
12. You are granted the permission to save the images that appear as part of the App, during the Game, on your tablet and/or mobile device, on which the App is installed, without removing any of BIM trademarks and/or trade names and/or logos, and/or other proprietary notices contained in or appearing on any of the images.
13. Without prejudice to any other provision of these Terms of Use you hereby acknowledge and agree that the App and all copyright, trademarks, trade secrets and other intellectual property associated therewith are, and shall remain the property of BIM at all times, other than a right explicitly granted to you by BIM and/or the right to use the App for its intended purpose only.

Limitation of Liability

14. The App and its content are provided “as is,” and BIM reserves the right to change or modify the App or service provided to you at any time and without any prior notice. BIM may change and/or modify the App, or any features or functions thereof, at any time and in its sole discretion. Thus, for example, certain functions described in the Game instructions and/or any other publication by BIM may not be active and/or certain functions that have not yet been described in the user manual and/or any other publication have already become active and/or a particular area allowing the activation of a particular function was disabled permanently and/or temporarily, all at the discretion of BIM, which is not obliged in any way to maintain these or other functions of the App and/or keep them activated.
15. BIM reserves the right to convert a function available to you free of charge, to an enhanced function for a fee.
16. BIM may, from time to time, change the structure and the appearance of the App, and the scope and availability of the services and the content provided in connection therewith, as well as terminate the provision of the App and/or its services without being required to give prior notice thereof. Such changes will be made, in part, given the dynamic nature of the Internet and other technological changes taking place, as well as due to occasional maintenance requirements. Changes, such as activity termination, may be permanent or temporary with respect to the entire App or certain parts of it, also due to third party conduct. You hereby declare that you shall have no contention and/or claim and/or demand against BIM relating to the execution of such changes or the resulting malfunctions.
17. For any queries, including technical issues, relating to the App, please contact BIM via email address: [email protected]. BIM will try to promptly respond to all inquiries, but it is not obligated to do so.
18. Users of the App shall have no claim, demand and/or other cause of action against BIM, except as to any claim relating to an explicit breach of these Terms of Use. BIM shall not be liable for any damage caused in connection with or following the use of the App, except as expressly provided herein or under the provisions of the law.
19. BIM and/or anyone on its behalf shall not be responsible or liable for any damage, direct or indirect, consequential or coincidental, including loss of profits or loss of data of any kind, caused to the user or a third party due to access to the App and/or use of the App and/or its information and/or due to any prevention of access to or use of the App, regardless of the grounds or nature of any claim.
20. BIM and/or anyone on its behalf shall not be responsible or liable for any damage caused by abuse and/or accident and/or misuse, as stated in the description of the Game, and/or wear and/or damage to third party products and/or damage to any device while using the App.
21. In any event, BIM and/or its executives and/or employees and/or suppliers shall not be liable for damages to devices and/or the App incurred while using the App.

Intellectual Property

22. All content and other materials accessible through the App, including, without limitation, the logo and all designs, text, graphics, pictures, information, data, software, sound files, other files and the selection and arrangement thereof (hereinafter: the “Content”) are the proprietary property of BIM only or of third parties, whose content is licensed to BIM. The trademarks, service marks, and logos used in the App are the property of BIM, or of other companies, and they may not be used without prior written consent of their respective owners.
23. The term “Content” in this document means all the information in the App, including pictures, graphics files, design of the App, software, video and audio files and other materials in the App, whether textual, visual, audio, or any combination thereof.
24. You may not copy, publicly display, transfer to third parties or use the Game / code / software / text / image, etc. from the App without prior the written consent of BIM, except for images that are labeled for use in accordance with these Terms of Use, and without removing the trademarks of BIM.
25. The use of the Content displayed in the App is for personal purposes only. You may not use, sell, copy, modify, distribute, redistribute, license, publicly display or provide any third party with the Content without BIM’s agreement in writing and in advance.
26. You are not allowed to make changes to the App and/or the services provided therewith. By using the App you agree not to use it for any illegal purpose, and not to modify and/or duplicate and/or copy and/or distribute and/or transfer the App and/or the Content and/or create derivative works and/or try and get the source code of the App and any other software component associated with it and/or the services provided therewith.

Miscellaneous

27. You shall be liable and hereby agree to indemnify, BIM and/or its employees, agents, and/or assigns, and to reimburse them for any claims, cost, expenses, losses, demands, damages, legal fees and costs, penalties, and/or liabilities of any kind or nature, arising out of any act or omission in breach of these Terms of Use and/or contrary to the law.
28. The provisions of the Terms of Use are to be regarded as an addition to any other provisions, and in the event of a discrepancy, the Terms of Use prevail.
29. All the rights to the Terms of Use are reserved to BUSTANAI, Law Offices.
30. All disputes arising from the usage of the App and its services shall be governed by the laws of the State of Israel and shall be submitted to the sole jurisdiction of the competent courts of Tel Aviv, Israel.
